This page (together with our privacy policy and acceptable use policy) tells you the terms and conditions on which we supply any of the products (Products) listed on our website www.seasaltcornwall.co.uk (our site) to you. Please read these terms and conditions carefully and make sure that you understand them, before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.

Information about us

We operate the website www.seasaltcornwall.co.uk. We are Seasalt Limited, a company registered in England and Wales under company number 02259954 and with our registered office at Unit 8 Falmouth Business Park, Bickland Water Road, Falmouth, Cornwall TR11 4SZ. Our VAT number is GB 163 0367 27.

Service availability

Our site is only intended for use by people resident in the countries listed in delivery policy and costs. We do not accept orders from individuals outside those countries.

Your status

By placing an order through our site, you warrant that:

  • you are legally capable of entering into binding contracts
  • you are purchasing the products outside the course of your normal business or trade and not for resale

How the contract is formed between you and us

After placing an order, you will receive an Email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been despatched (Despatch Confirmation). The contract between us (Contract) will only be formed when we send you the Despatch Confirmation.

The Contract will relate only to those Products whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the despatch of such Products has been confirmed in a separate Despatch Confirmation.

Stock availability

We do try to ensure that we have good stock availability of all products. However, some goods may sell faster than we predict. If the item you have ordered is not in stock, we will do our best to get it for you as quickly as possible. If we cannot get the item we will cancel your order immediately and let you know by email.

If we can get the item, but cannot deliver it to you within our delivery policy, we will email you with the option to cancel your order.

Conformity of the products

We warrant to you that any Product purchased from us through our site will, on delivery, conform in all material respects with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.

Every care has been taken to ensure that the descriptions and specifications of our products on this web site are correct. However, whilst the colour reproduction is an extremely close representation, a slight variation in the actual goods can occur.

Price and payment

The price of the Products and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error.

If you are ordering from the U.K or European Union all prices are shown in sterling and include 20% VAT on adult’s clothing and 0% VAT on Seasalt Gift Cards. If you are ordering from outside the UK and European Union or from the Channel Islands, all prices are shown in sterling and exclude VAT.

Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Despatch Confirmation.

If you are ordering from outside the UK or European Union, your order will be supplied VAT free and a copy of your ex VAT receipt will be despatched with your goods. As all orders are shipped directly from the UK, you may have to pay customs fees when your parcel reaches the country you live in. You are responsible for any import duties, customs and local sales taxes, and you’ll need to pay these fees to release your order from customs. We don’t have any control over customs and import tax and we can't tell you exactly how much you will be charged, as this varies widely depending on the country you live in (for example, the threshold for goods imported to United State of America is $800, and Canada is $20CAD). Any orders with a value above the threshold amount will be charged import fees, so we recommend contacting your local customs office for more information before placing your order. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. All prices include VAT or GST where applicable.

Seasalt Gift Cards

Seasalt Gift Cards can be purchased online, in Seasalt shops in the UK & CI only or over the phone, from our Customer Services team.

Seasalt Gift Cards are available from a minimum value of £5 to a maximum value of £500.

Your Seasalt Gift Card will be valid for 24 months from the date given on its face.

After 24 consecutive months the cardyour Seasalt Gift Card will expire and the balance on the card will be lost.

Seasalt Gift Cards can be used online, in Seasalt shops (in the UK & CI only) or over the phone with our Customer Services team. To find your nearest shop, please visit www.seasaltcornwall.co.uk/locations.

For the avoidance of doubt, Seasalt Gift Cards cannot be used in our Clonakilty store.

To use an Email Gift Card, download it following the instructions in the email.

You can spend your Seasalt Gift Card at www.seasaltcornwall.co.uk or in any UK based Seasalt shop (not including stockists).

To use your Seasalt Gift Card online, select ‘Redeem a Gift Card’ at the checkout, then enter the 16-digit number and PIN.

To use your Seasalt Gift Card in a Seasalt Shop in the UK, simply show your Email Gift Card on your phone or tablet or print your Seasalt Gift Card PDF and present it at the till.

If you’d like to spend your Seasalt Gift Card on something that costs more than the Gift Card value, you will simply need to pay the difference.

If you’d like to spend your Seasalt Gift Card on something that costs less than the Gift Card value, the amount of your purchase will be deducted and you can then use the remaining balance for future purchases. We are not able to give change.

Seasalt Gift Cards cannot be exchanged for cash.

Balances from a Seasalt Gift Card cannot be transferred onto another Seasalt Gift Card. Seasalt Gift Cards cannot be used to purchase Seasalt Gift Cards.

For balance enquiries, please ask in any Seasalt shop (in the UK & CI only) or check your balance online at www.seasaltcornwall.co.uk/customer/check_giftcard_balance.

Take care of your Seasalt Gift Card, as you would cash – Seasalt will not accept liability for lost, stolen or damaged Seasalt Gift Cards.

Seasalt will cancel the value of the Seasalt Gift Card where the fraudulent use of a credit card is suspected.

If you’d like to refund or exchange something purchased with a Seasalt Gift Card the Seasalt Refund Policy will apply. This does not affect your statutory rights.

Seasalt reserves the right to amend our Seasalt Gift Card Terms & Conditions at any time and to take appropriate action, including the cancellation of the Gift Card, if we deem such action necessary. This does not affect your statutory rights.

Seasalt reserves the right to refuse to accept a Seasalt Gift Card in payment or part, where it reasonably suspects that the Seasalt Gift Card or any amount on it may have been stolen, tampered with, duplicated or obtained in another illegal way.

Seasalt Gift Cards will be verified at the time of payment and each individual shop reserves the right not to accept any Gift Card if it has or appears to have been forged, damaged, defaced or otherwise tampered with.

Mispricings

Despite our best efforts, items in our online shop may occasionally be mispriced. We verify prices as part of our despatch procedures and if an item’s correct price is lower than the price shown online, we will charge you the lower amount and send you the item. If the item’s correct price is higher than the price shown online, we will contact you for instructions before the Despatch Confirmation is sent out. For the avoidance of doubt, Seasalt shall be under no obligation to honour the incorrect price or Order.

To pay for your order

Payment for all Products must be by credit or debit card or by PayPal. We accept payment with Visa, MasterCard and American Express credit cards, as well as Maestro, Visa Electron and Visa Debit cards.


We do not accept payment by cheque.  

 

You can only see our price list in sterling, but we accept card payments from anywhere in the world.

To protect credit and debit cardholders, all payments are screened using 3D Secure (MasterCard SecureCode and Verified by Visa) and by an independent fraud prevention service. We may contact you for additional security purposes should we deem this necessary.

Complaints

In the event of you having a complaint or problem with any aspect of our service or the products we offer, please telephone us on +44 (0) 1326 640075 or click here to inform us by email. We take all complaints extremely seriously and we will try to rectify any problem quickly and effectively.

Our Customer Service representatives are available between 8:00 am and 8.00 pm (GMT) Monday to Friday, 8:00am and 5:00 pm Saturday, and between 10:00 am and 4.00 pm on Sunday

All complaints will be acknowledged within 1 working day and will be resolved as soon as possible. We will always keep you informed throughout the process of resolving your complaint and we will keep the details of your complaint confidential. We always welcome feedback from our customers and are continually looking at ways to improve our service.

Alternative dispute resolution

Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with the resolution of our complaints process, Alternative Dispute Resolution is available, including online dispute resolution at http://ec.europa.eu/consumers/odr/

General T's & C's

Risk and title

The Products will be your responsibility from the time of delivery.

Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Notices

All notices given by you to us must be given to us at Unit 8 Falmouth Business Park, Bickland Water Road, Falmouth, Cornwall TR11 4SZ or contactus@seasaltcornwall.co.uk. We may give notice to you at either the e-mail or postal address you provide to us when placing an order. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

Transfer of rights and obligations

The contract between you and us is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

Waiver

If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

A waiver by us of any default will not constitute a waiver of any subsequent default.

No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability

If any court or competent authority decides that any of the provisions of these terms and Conditions or any provisions of a Contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

Entire agreement

These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any Contract.

We each acknowledge that, in entering into a Contract, neither of us relies on any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them.

Each of us agrees that our only liability in respect of those representations and warranties that are set out in this agreement (whether made innocently or negligently) will be for breach of contract.

Nothing in this clause limits or excludes any liability for fraud.

Our right to vary these terms and conditions

We have the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Despatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

Law and jurisdiction

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Third party rights

A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

#FeelGoodFriday

The #FeelGoodFriday competition closes at midnight on the Sunday after the competition goes live on Facebook. The winner(s) will be chosen at random and will be tagged in their original comment. The winner(s) must contact Seasalt via the email address provided (competitions@seasaltcornwall.co.uk) within 72 hours in order to confirm acceptance and arrange receipt of their prize. Should the prize not be claimed within 72 hours, a new winner will be selected at random. The prize will be stated in the competition post and is subject to availability. By entering the competition you have the legal capacity to do so and agree to these terms and conditions. There is no entry fee and no purchase required. The competition is open to people aged 18 or over, except employees of Seasalt or anyone professionally associated with this promotion. Prizes are non-transferable and non-exchangeable. Seasalt Shop Loyalty Card

  • These Terms and Conditions, together with the Seasalt Cornwall privacy policy, govern the Seasalt Shop Loyalty scheme, and any application for participation in the scheme will be treated as acceptance of these terms and conditions. Additional terms and conditions may apply for additional elements of the scheme, such as competitions and prize draws.
  • Our Seasalt Shop Loyalty Cards launches on 15th June 2019 until further notice.
  • Seasalt Shop Loyalty Cards can be used in Seasalt shops (in the UK & CI only). To find your nearest shop, please visit www.seasaltcornwall.co.uk/locations.
  • Seasalt Shop Loyalty Cards cannot currently be used in our Clonakilty store, in any Seasalt stockists or online.
  • Seasalt Shop Loyalty Cards cannot be exchanged for cash.
  • Seasalt Shop Loyalty Cards are not valid against the purchase of Seasalt Gift Cards.
  • Each card belongs to the customer who registered it, cards cannot be shared. Members of the Loyalty Scheme are entitled to one membership only. Stamps are non-transferrable and may not be “saved up” and added to someone else’s card.
  • Stamps are awarded for every £50 spend in one transaction only, stamps cannot be awarded for multiple transactions totalling £50 or over.
  • You must provide the required personal details to sign up (customer name and email address or address are the minimum requirement). We will use your contact details to let you know about Seasalt offers, products and services that are the most likely to interest you. The GDPR allows us to do this as part of our legitimate interest in understanding our customers and providing the highest levels of service. As a member of the Loyalty Card scheme we will also send you news and information about Seasalt events that will enable you to earn more stamps. It also helps us check for fraud.   • Seasalt reserves the right to amend our Seasalt Shop Loyalty Card Terms & Conditions at any time and to take appropriate action, including the cancellation of the card, if it becomes necessary. This does not affect your statutory rights.
  • Seasalt will not accept liability for lost or stolen Seasalt Shop Loyalty Cards but damaged cards may be replaced at Seasalt’s discretion.
  • Seasalt reserves the right to cancel a Seasalt Shop Loyalty Card, where the fraudulent use of a credit card is suspected, or where Seasalt suspects a breach of these Terms & Conditions or abuse of the scheme, or any behaviour relating to the scheme that involves theft, misconduct, offensive or misleading behaviour.
  • Seasalt reserves the right to refuse to accept a Seasalt Shop Loyalty Card, where it reasonably suspects that the Seasalt Shop Loyalty Card may have been stolen, tampered with, duplicated or obtained in another illegal way.
  • Seasalt Shop Loyalty Cards will be verified at the time of issue and each individual shop reserves the right not to accept any Seasalt Shop Loyalty Card if it has or appears to have been forged, damaged, defaced or otherwise tampered with.

Knitwear debobbling service

Terms and Conditions

During busy periods, our shops will be limited to treating only 4 pieces per day. Any additional items brought in will be returned to our customer services team and posted directly back to you. Please send no more than 2 knitwear pieces at any one time.

Once we receive your knitwear, we will aim to treat it within 1 working day and return on a 48 hour service. Please allow 5 working days to receive your restored knitwear.

Results will vary depending on the wear that your knitwear has had. We’ll aim to restore it to its best possible condition taking into account wear and tear. Please note, we are unable to mend or repair any other damage.

If you’re not fully satisfied with your garment after de-bobbling, we will offer you an exchange or refund.

We will only de-bobble Seasalt knitwear.

Seasalt’s Red Magazine Giveaway is a prize draw open to all UK residents aged 18 years or over, except employees of Seasalt, their families, agents or any third party directly associated with administration of the competition. The prize draw is free to enter and no purchase is necessary.

By entering, you are accepting these Terms and Conditions.

Entries

Access to entry of the prize draw is via an entry form on our website, www.seasaltcornwall.co.uk/redmagazine. We cannot accept entries by post, via direct email or through Seasalt’s social media accounts.

The prize draw is open from Wednesday 4th December until midnight of the 31st December. Entries after this time will not be counted. Personal Data Protection

All personal data provided by you as part of your entry to this draw will be treated in accordance with the GDPR. Please see our Privacy Policy (clauses 1.9 and 1.10) for further information.

Personal data supplied during the course of this promotion may be passed on to third party suppliers only insofar as required for fulfilment, delivery and arrangement of the prize.

Prize

1 winner will each receive a £250 Seasalt Gift Card and one year’s subscription to Red Magazine. 5 runners up will also receive a year’s subscription to Red Magazine. Prizes are subject to availability, are non-transferable, non-refundable, non-exchangeable and there are no cash alternatives available.

If Seasalt are unable to provide the stated prizes, they reserve the right to offer an alternative prize of equal or higher value. Seasalt’s decision is final and no correspondence will be entered into.

Winners

Each of the winners will be chosen at random within 72 hours of the end of the competition.

Winners will be notified via the email address provided, and must confirm their details and reply via email within 72 hours to claim their prize. If a winner does not respond to Seasalt within 72 hours of being contacted, Seasalt will select another winner at random.

Once all winners have confirmed the above, all entrants will be notified by email that they have been unsuccessful. All entrants who have not given consent to marketing messages will be removed from our database after 14 days of this email.

The name of each winner will be available on request from the offices of Seasalt Limited for one month after the winners have been named and claimed their prizes.

The prize winners may be required to participate in reasonable publicity; Seasalt reserves the right to use names of winners, their photographs and audio/visual recordings of them in publicity. Photos may be used in the press or online.

The winner will be chosen at random and will receive an gift voucher via email by 20th December 2019. The prize is non-transferable and no cash alternative is offered. Seasalt must publish or make available information that indicates that a valid award has taken place. Refer a Friend

  1. What is the refer-a-friend scheme and how do I start using it?
    This scheme is for you to refer a friend who isn’t a customer of ours, so you both receive a treat. Once you have placed an order, you will be invited to join the scheme and refer friends. Then, when your friend has redeemed their treat (entering your name at checkout) you will get your reward for referring a friend.
  2. I can’t find my friend when I search for them at checkout?
    Please make sure you enter your friend’s name correctly, if we can’t find your friend in the system, you’ll be asked to enter their email address. If you are unsure of these details please ask the friend that referred you.
  3. Can the scheme/codes been used in store?
    The refer-a-friend scheme can’t be used in our shops unfortunately. To ensure the scheme works and your friend receives their reward your code must be used online.
  4. Can the codes be used more than once?
    No, codes can only be used once.
  5. Can I refer more than one friend?
    Yes, and each time you introduce a new customer to Seasalt via the referral programme and they place an order with us, they will receive a reward. We do monitor the programme to make sure there is no self-referring or fraudulent use.
  6. What is classed as inappropriate use?
    Rewards will be cumulative and so if multiple qualifying referrals are made to Seasalt, multiple rewards will be delivered to the referrer, subject to a limit. A Referrer may not earn more than 5 within any 24 hour period or 25 within last 12 months or 1500 GBP of reward value within last 12 months.
  7. How long is my code valid for?
    This will be shown on your offer code email.
  8. I’ve forgotten to add my code in at checkout, what do I do?
    Once your order has arrived and you’ve decided what you’re keeping, please contact our friendly customer service who will be happy to help. contactus@seasaltcornwall.co.uk or 01326 640075.
  9. I’ve referred a friend but not received a reward?
    Please check with your friend to see if they have placed an order with us. They also need to have mentioned your name at the checkout. If they haven’t ordered with us yet or mentioned your name when placing the order, you won’t get your reward.
  10. I’ve referred lots of friends but not received the same amount of rewards back?
    It may be that not all your friends have chosen to place an order with us. You will only receive a reward once your friend has placed an order entering your name at the checkout. Your friend will also need to be a new customer to Seasalt, so if the friend already shops with us, then you will not get a reward.
  11. I’ve lost my code, what do I do?
